Cursor Pixie Terms of Use
These Terms of Use ("Terms") govern your use of Cursor Pixie, a macOS application provided by Shinya Yoshiitaka ("Provider").
1. Scope
These Terms apply to your use of the App and related support provided by the Provider.
2. App Functionality
Cursor Pixie provides a decorative image overlay near the system cursor. It does not replace or hide the system cursor.
Payment and refunds for optional support (Tip Jar) in the App are handled under Apple's systems and terms.
3. Prohibited Conduct
- Any conduct that violates applicable laws or public order
- Any conduct that interferes with operation of the App or related services
- Unauthorized access, reverse engineering, modification, or redistribution that infringes rights
4. Disclaimer
- The App is provided "as is" without warranties of completeness, accuracy, or fitness for a particular purpose.
- The Provider is not liable for damages arising from use of the App, except in cases of willful misconduct or gross negligence.
- Where liability cannot be fully disclaimed, and to the maximum extent permitted by applicable law, liability is limited to ordinary and direct damages actually incurred by the user.
- The Provider is not liable for special, indirect, incidental, consequential, or punitive damages, including lost profits, data loss, or business interruption.
- The total aggregate liability of the Provider is limited to the total amount actually paid by the user in connection with the App during the 12 months immediately preceding the event giving rise to liability.
- Some features may not work as expected due to OS changes, device environment, or interaction with other apps.
5. Changes and Termination
The Provider may modify, suspend, or discontinue the App at any time without prior notice.
6. Changes to These Terms
The Provider may update these Terms when necessary. Updated Terms become effective when posted on this site or an App-related page. Continued use of the App after such posting constitutes acceptance of the updated Terms.
7. Intellectual Property
All intellectual property rights related to the App belong to the Provider or lawful rights holders.
8. Severability
If any provision of these Terms is held invalid or unenforceable under applicable law, the remaining provisions remain in full force and effect.
9. Governing Law and Jurisdiction
These Terms are governed by the laws of Japan. The Tokyo District Court has exclusive jurisdiction as the court of first instance for disputes related to the App.
